Sinatra App Terms of Service

• 1. Introduction

  Welcome to Sinatra, an application designed to act as a co-pilot in managing e-commerce operations. These Terms of Service (“Terms”) govern the use of the Sinatra app and its associated services. By using Sinatra, you fully agree to these Terms. If you disagree with any provision contained herein, you must immediately cease using the app.

• 2. Acceptance of Terms

  Access to and use of Sinatra are conditioned on your acceptance of and compliance with these Terms. By accessing or using Sinatra, you express your acceptance of all terms and conditions set forth herein. If you do not agree with any part of the Terms, you must not use the app.

• 3. Eligibility

  The use of Sinatra is restricted to individuals with full legal capacity to enter into binding contracts, including, but not limited to, those over 18 years of age or the legal age in their jurisdiction. Furthermore, you must be a store owner or an authorized administrator of an online store. By using the app, you declare and warrant that you meet these requirements.

• 4. Account Creation

  To use the features offered by Sinatra, you must create an account, providing accurate and up-to-date information. You are responsible for maintaining the confidentiality of your password and other access credentials, as well as for all activities carried out under your account. It is your duty to immediately notify the Sinatra team of any unauthorized use of your account or any other security breach.

• 5. Permitted Use

  Sinatra is intended exclusively to support e-commerce operations, providing tools for the management, automation, and optimization of online stores. You agree to use the app only for lawful purposes and in compliance with these Terms, refraining from practices that may harm the functioning of Sinatra or violate the rights of third parties. It is expressly forbidden to attempt to access restricted systems, modify, or manipulate the app in any unauthorized way.

• 6. Store Content and Data

  Sinatra may access, process, and use data related to your store, including, but not limited to, information about products, orders, customers, and sales performance, for the purpose of providing the contracted services. By using Sinatra, you grant the app a non-exclusive, global, and royalty-free license to access and process this data. You declare and warrant that you have all necessary rights over the data provided to allow Sinatra to use it as described.

• 7. Payments and Subscriptions

  Certain Sinatra features may be available upon payment of fees or subscription to specific plans. By opting for a paid service, you agree to provide accurate and valid payment information and to pay all applicable fees. Unless otherwise provided, all sales are final and no refunds are offered, except as required by law.

• 8. Privacy

  Respect for your privacy is a priority for Sinatra. Personal and commercial data collected by the app will be used in accordance with our Privacy Policy, which describes in detail the practices of collecting, using, storing, and protecting your information.

• 9. Termination

  Sinatra reserves the right, at its sole discretion, to suspend or terminate your access to the app, with or without prior notice, if you violate any provision of these Terms or if your conduct is considered harmful to Sinatra, other users, or third parties. You can terminate your account at any time; however, there will be no refund of paid amounts due to termination, unless otherwise required by law.

• 10. Limitation of Liability

  Sinatra is provided “as is” and “as available,” without any express or implied warranty. We do not guarantee that the service will be uninterrupted, secure, or free of errors. In no event shall Sinatra or its affiliates be liable for any direct, indirect, incidental, special, or consequential damages, including, without limitation, lost profits, data loss, or other damages arising from the use or inability to use the app.

• 11. Indemnification

  You agree to indemnify, defend, and hold Sinatra, its directors, employees, partners, and affiliates harmless from any claims, demands, losses, liabilities, and costs, including reasonable attorneys' fees, arising from or related to your improper use of the app, violation of these Terms, or violation of any third-party rights.

• 12. Modifications to the Terms

  Sinatra reserves the right to, at any time, alter or modify these Terms. Any changes will be immediately applicable from the publication of the revised Terms on the app. The continued use of Sinatra after said publication will be considered as acceptance of the modified Terms.

• 13. Governing Law and Jurisdiction

  These Terms will be governed by and interpreted in accordance with the laws of Brazil, without considering their conflicts of legal provisions. The parties elect the jurisdiction of the city of Rio de Janeiro, with express waiver of any other, however privileged it may be, to resolve any disputes arising from these Terms.
